Description

The Lok Sabha recently approved the Boilers Bill, 2024, replacing the Boilers Act of 1923, which had governed steam boiler regulation for over a century. The new legislation aims to decriminalize certain offences, simplify compliance, and enhance safety measures, making it easier for businesses to operate while ensuring worker protection.

Background Of Boilers Bill, 2024

The Boilers Act of 1923 was originally introduced to regulate the manufacture, installation, operation, alteration, and repair of steam boilers to prevent industrial accidents and ensure safety.

  • The last significant amendment was made in 2007, allowing independent third-party inspections to improve regulatory efficiency.

  • However, with evolving industrial needs, further legal and procedural reforms were necessary.

  • The Boilers Bill, 2024 is aligned with the Jan Vishwas (Amendment of Provisions) Act, 2023, which promotes decriminalization and ease of doing business (EoDB).

  • The Bill has been modernized with clearer language and structured drafting, making it more accessible and practical.

Key Features Of Boilers Bill, 2024

Repeal of the Boilers Act, 1923 - The new law replaces outdated regulations with modern safety standards that reflect technological advancements in steam boilers.

Ease of Doing Business (EoDB) - The bill introduces business-friendly reforms by eliminating legal complexities and decriminalizing three out of seven offences to reduce judicial intervention.

Categorization of Offences - Serious Offences (Endangering Life & Property): Criminal penalties remain in place. Less Severe Violations: Converted into monetary fines, handled through an administrative mechanism rather than court proceedings.

Simplified & Modernized Structure - The bill has been streamlined into six chapters, grouping similar provisions together for better clarity. Ambiguous and redundant clauses from the pre-constitutional era have been removed. New definitions and updated provisions ensure legal precision.

Strengthened Safety Standards - The bill prioritizes worker protection by mandating boiler maintenance and repairs to be carried out by certified professionals. This ensures that safety measures align with global best practices.

Alignment with Jan Vishwas Act, 2023 - The bill supports the government’s ongoing reform agenda, which seeks to decriminalize regulatory offences and encourage business growth.

Clear Roles for Central and State Governments - Defines the responsibilities of the Central Government, State Governments, and the Central Boilers Board to avoid overlapping jurisdiction and streamline decision-making.

Understanding Boilers And Their Industrial Significance

  • A boiler is an industrial vessel used to generate steam under pressure, essential for various industrial applications.

  • India has approximately 40 lakh steam boilers across industries like power generation, manufacturing, and chemicals.

  • Boilers fall under the Concurrent List of the Indian Constitution, meaning both the Central and State Governments have legislative authority over their regulation.

The Boilers Bill, 2024 marks a significant step forward in modernizing India’s industrial regulatory framework. By removing obsolete provisions, decriminalizing minor offences, and reinforcing safety measures, the bill ensures that India’s industries can function efficiently without compromising on safety and compliance. This reform aligns with India’s vision for ease of doing business while prioritizing worker well-being and technological advancement.
