The Uttarakhand government has recently approved a draft law that aims to restrict land purchases by non-residents in most districts of the state. This move addresses long-standing public concerns about protecting local resources and preserving cultural heritage. The draft law will be presented in the upcoming assembly budget session, which concludes on February 24, 2025.

Key Provisions Of New Law

The proposed legislation restricts individuals from outside Uttarakhand from purchasing agricultural and horticultural land in 11 out of the state's 13 districts. The only exceptions to this rule are Haridwar and Udham Singh Nagar districts. Additionally, the law reinstates previous limits on land purchases and introduces a tracking portal to monitor all land transactions.

Revocation Of Previous Amendments

The new law also nullifies the 2018 amendments made during the tenure of the Trivendra Singh Rawat government. These amendments had raised the land purchase limit in hilly areas and transferred approval authority for land transactions from the state government to district magistrates. The current draft law reverses these changes, restoring control over land purchases to the state administration.

Mandatory Affidavits And Reporting

Under the updated law, non-residents will be required to submit an affidavit when buying land in Uttarakhand. This provision is intended to prevent fraudulent transactions and ensure greater transparency. Additionally, district magistrates will be mandated to regularly report land purchases to the Revenue Council.

Land Use Restrictions

The new law will also impose restrictions on land use within municipal areas. Land that is used for purposes other than its designated use will revert to government ownership. This provision is designed to prevent misuse and promote better management of land resources.

Historical Context

Land purchase restrictions for non-residents in Uttarakhand date back to the early 2000s when the Congress government first implemented limits. These restrictions were later modified under the BJP government. The 2017 amendments lifted many of these limits, leading to concerns about land hoarding by outsiders and sparking public protests.

Opposition Response

The opposition has criticized the government for reversing the changes made in 2018. They claim that since those amendments, thousands of acres of land have been sold to non-residents. There have been growing demands for greater transparency and accountability in land transactions to ensure the protection of local interests.
