The Supreme Court issued notice to private parties on Friday in response to the National Testing Agency's (NTA) request that cases pending in various high courts on the NEET UG row be transferred to the top court in order to avoid double litigation. Furthermore, the Supreme Court has issued notifications to the Centre and the NTA in response to a petition asking a CBI investigation into accusations of question paper leakage and other irregularities in the NEET UG 2024.
A vacation bench of Justices Vikram Nath and Sandeep Mehta took note of the NTA's counsel's submission that several petitions seeking cancellation of the National Eligibility Cum Entrance Test Under Graduate (NEET UG) 2024 on allegations of question paper leak and other malpractices are pending in several high courts.
"Issue notice," the bench stated, adding that the cases will be heard on July 8.
The vacation bench also asked for responses from the Central Bureau of Investigation (CBI) and the Bihar government within two weeks. It stated that the PIL, along with other outstanding cases, will be heard on July 8, when the Supreme Court resumes operations following its summer break.
Meanwhile, the NTA stated that it intended to drop three other petitions that sought to transfer cases from high courts to the Supreme Court, since they related to the grant of grace marks to 1,563 candidates due to time loss during the May 5 examination.
The NTA's counsel stated that the issue has been resolved and that he will inform the high court of the decision to annul the compensatory marks awarded to 1,536 candidates, as well as the top court's subsequent June 13 order.
In the midst of a blazing debate over the NEET UG examination, the Centre and the NTA informed the Supreme Court on June 13 that they have canceled the grace marks awarded to 1,563 candidates who appeared in the exam for admission to MBBS and other similar courses.
They will be given the choice of re appearing in the test or foregoing the compensatory marks offered to them for time lost, according to the centre.
The exam was held on May 5 at 4,750 locations, and around 24 lakh students appeared in it. The results were supposed to be released on June 14, but they were announced on June 4, presumably because the review of the answer sheets was completed early.
The charges have sparked rallies in various locations, as well as the filing of petitions in seven high courts, including the Supreme Court. On June 10, scores of students protested in Delhi, calling for an investigation into alleged irregularities.
As many as 67 students achieved perfect 720s, an unprecedented number in NTA history, with six from a center in Haryana's Faridabad making the list, sparking concerns of fraud. It has been claimed that grace marks contributed to 67 students sharing the top rank.
The NTA administers the NEET-UG examination for admission to MBBS, BDS, AYUSH, and other relevant courses at both government and private institutions across the country.
