Description

Overview

The laws on extended producer responsibility, as well as the restriction of specified single-use plastic goods with low utility and high littering potential, go into effect on July 1, 2022, and are critical measures in decreasing pollution produced by plastic waste in the country.

What are the guidelines?

The recommendations provide forth a framework for improving the circular economy of plastic packaging waste, stimulating the development of plastic alternatives, and creating measures for businesses transitioning to sustainable plastic packaging. The reuse of rigid plastic packaging material is required by the standards to decrease the use of fresh plastic material for packaging.

The rules will assist to formalise and expand the plastic waste management business. For the first time, the rules allow the sale and purchase of surplus extended producer responsibility certificates, enabling a market system for plastic waste management.

When producers, importers, and brand owners fail to meet extended producer responsibility targets, the guidelines establish a framework for levying environmental compensation based on the polluter pays principle, with the goal of protecting and improving the environment and preventing, controlling, and lessening pollution. Environmental compensation does not absolve manufacturers, importers, or brand owners of their obligations under these regulations. Uncompleted EPR duties will be handed over to the following year.

Implementation

EPR will be deployed via a tailored online platform. The online site will enable enterprises to manage and monitor their EPR needs while also reducing their compliance burden by allowing them to register and complete yearly filings online. To ensure that EPR duties are satisfied, a robust verification and audit mechanism will be created.

The government has also demanded that the Central Pollution Control Board build a consolidated online platform by March 31 for manufacturers, importers, and brand owners to register and file yearly returns.
